How to End a Lease in the Czech Republic (and Leave a Shared Flat Early)

Notice periods for indefinite and fixed-term leases under Czech law, the three ways out of a one-year contract, what to do when you share a lease, and a notice template.

A new job in another city, a relationship that moved in, a flatmate who moved out. Sooner or later you need to leave a flat before you planned to. In the Czech Republic how hard that is depends almost entirely on one line in your contract: whether the lease is for an indefinite period (na dobu neurčitou) or a fixed term (na dobu určitou). Here is what the Civil Code actually says, what it means for a shared flat, and a notice template you can use.

First, which contract do you have?

Look for two things. One: is there an end date, or does it say na dobu neurčitou? Two: is the other party the owner of the flat (nájem) or another tenant (podnájem)? Subletting follows different rules, covered in Lease vs Sublease, and the main thing to know is that a sublease ends automatically when the main lease ends, whatever your own paper says.

Indefinite lease: three months, no reason needed

This is the easy case. As tenant you can terminate an indefinite lease at any time with a three-month notice period and you do not have to give a reason (Civil Code § 2231). Three rules matter in practice:

  • The notice must be in writing and must reach the landlord. Email is risky unless the contract allows it; registered post with delivery confirmation or a data box (datová schránka) is safe.
  • The three months start on the first day of the month after the landlord receives it. Notice delivered on 10 October means the lease ends on 31 January.
  • You pay rent for the whole notice period, even if you move out earlier, unless you agree otherwise in writing.

Fixed-term lease: you cannot simply give notice

Most first leases in Prague and Brno are for one year. A fixed-term tenant cannot terminate freely; the law gives you three ways out:

  1. Change of circumstances (§ 2287). If the circumstances the contract was based on change so much that you cannot reasonably be expected to continue, you can give notice. A job in another city you cannot commute to is the textbook example. You still serve the three-month notice period, and the landlord can dispute the reason.
  2. Agreement (dohoda o skončení nájmu). The route almost everyone actually uses. You and the landlord sign a short agreement ending the lease on a date you both accept. Landlords usually say yes when you bring a replacement tenant they can approve, because it saves them a month of viewings.
  3. Immediate termination for serious breach (§ 2232). If the flat is uninhabitable, the landlord refuses essential repairs, or you cannot use the flat undisturbed, you can end the lease without a notice period. Document everything first; this one ends in court if disputed.

A clause in the contract that lets you give notice on a fixed-term lease is valid and common; check for one before assuming you are stuck. Any contractual penalty (smluvní pokuta) together with the deposit cannot exceed three months' rent in total (§ 2254).

When the landlord wants you out

The rules are stricter on their side. A landlord can only give notice for the reasons listed in § 2288 (serious breach of your duties, a conviction for an intentional crime against them or the building, the flat must be vacated in the public interest, or another comparably serious reason), with three months' notice, in writing, and the notice must tell you that you have two months to object in court. A notice without that instruction is invalid. Not paying rent for three months or more allows termination without a notice period.

Also useful: if a fixed-term lease expires and you keep living there for three months without the landlord asking you in writing to leave, the lease renews on the same terms for the same period, up to two years (§ 2285).

Leaving a shared flat early

If all of you are on one lease, you cannot leave alone; the lease is shared and so is the liability. In practice you need three things: a replacement the landlord and the flatmates accept, an amendment to the contract swapping the names, and a written settlement of your share of the deposit with the person taking your room. If you are subletting a room from the main tenant, your notice period is whatever your sublease says; if it says nothing, the general lease rules apply. Either way, tell the main tenant early and help find the next person. It is the difference between a clean exit and a deposit argument.

The last day

Hand over the flat in the condition you received it, allowing for normal wear. Do a written handover protocol with meter readings, photos and the number of keys, signed by both sides. Notice template (indefinite lease)

Send it in Czech; the English translation below is for your own understanding. Replace the brackets.

Výpověď nájmu bytu. Pronajímatel: [jméno, adresa]. Nájemce: [jméno, adresa]. Byt: [adresa bytu, číslo bytu]. Smlouva o nájmu ze dne [datum]. Tímto vypovídám nájem uvedeného bytu podle § 2231 zákona č. 89/2012 Sb., občanský zákoník. Nájem je sjednán na dobu neurčitou, výpověď proto neobsahuje důvod. In English: Notice of termination of the apartment lease. Landlord, tenant, flat address, lease dated. I hereby terminate the lease of the above flat under § 2231 of Act No. 89/2012 Coll. The lease is for an indefinite period, so no reason is given. The notice period is three months, starting on the first day of the month following delivery. I will vacate and hand over the flat on the end date. I ask for written confirmation of receipt, a handover date with a protocol and meter readings, and the return of the deposit to account number [..].
